NATURE OF THE SERVICE
ROACH (Rugged Offline Autonomous Compute Hardware) is a hardware tool designed by ROACH LLC to host and process data locally. You acknowledge that ROACH is an experimental platform. By using this device, you agree that you are the sole operator of a local, air-gapped Large Language Model (LLM) and that ROACH does not communicate with a central authority or "fact-checker" once in your possession.

No Real-Time Updates: Because ROACH is an air-gapped system, it cannot verify its responses against the current internet. Information provided may be obsolete or superseded.
GENERATED OUTPUT & "HALLUCINATIONS"

Non-Deterministic Output: You understand that Generative AI is non-deterministic. ROACH may generate responses that are technically incorrect, misleading, or "hallucinated."

No Control: We have no control over the specific responses the AI generates in an offline environment. You are solely responsible for evaluating the correctness and appropriateness of any output before taking action.

LIMITATION OF LIABILITY
To the maximum extent permitted by law, ROACH, ROACH LLC, its founders, and its parent company shall not be held liable for any direct, indirect, incidental, or consequential damages—including but not limited to physical injury, property damage, or death—arising from:

The use of preloaded data that has become obsolete.
LIMITATION OF LIABILITY & "GRID-DOWN" INDEMNITY
To the fullest extent permitted by law, ROACH and its parent company disclaim all liability for any injury, property damage, or death resulting from the use or misuse of the device.

Action at Your Own Risk: Any action taken based on ROACH’s output—including but not limited to medical procedures, tactical maneuvers, or mechanical repairs—is done at your sole discretion and extreme risk.

Force Majeure (Grid Collapse): We are not liable for any failure of the device during a total infrastructure failure, grid collapse, or "SHTF" event. Your ability to use the device in a crisis is subject to your own maintenance of its power systems (batteries/solar).
USER-UPLOADED DATA
You are solely responsible for any data you upload via the USB-C airlock. ROACH does not screen, backup, or verify user-uploaded content. You represent that you have the legal right to possess and process any data you add to the device.
USER-GENERATED DATA & PRIVACY

Airlock Responsibility: You are solely responsible for all data ingested via the USB-C airlock. We have no access to your offline data and cannot recover it if lost or corrupted.

Air-Gapped Privacy: We do not collect, store, or transmit your prompts or the AI’s responses. Your digital soul stays on the silicon.
Force Majeure: Grid-Down Protocol
Definition of Qualifying Event For the purposes of this agreement, a "Force Majeure Event" explicitly includes, but is not limited to:

Total or Regional Grid Collapse: Any sustained failure of the electrical, cellular, or satellite infrastructure.

Acts of War or Insurrection: Kinetic or cyber-warfare resulting in the destruction of communication nodes.

EMP or HEMP Events: Electromagnetic pulses that exceed the protective specifications of the ROACH Faraday shield.
Suspension of Performance Upon the occurrence of a total grid collapse, the company’s obligations—including customer support, software updates, and "Sneakernet" deliveries—are immediately suspended. Performance is excused only to the extent that the event prevents the company from fulfilling its duties.
No Liability for Indirect Failure The company shall not be held liable for any injury, loss of life, or property damage resulting from the inability to access remote support or data updates during a Force Majeure event. While ROACH is built for resilience, its performance is subject to the supervening impossibility of maintaining business operations during a total infrastructure failure.
Mitigation and Resumption The company will use all reasonable endeavors to resume "Sneakernet" operations and data synchronization as soon as local or regional infrastructure is restored. However, the company is not required to accept "non-contractual performance"—meaning we are not legally obligated to provide alternative, non-verified data sources during the crisis.
BINDING ARBITRATION
By purchasing or using ROACH, you agree to resolve all disputes through binding individual arbitration. You explicitly waive your right to a trial by jury or to participate in any class-action lawsuit against ROACH or its founders.
